Private Planned Communities Cannot Impose Lifetime Bans on Sex Offenders

In Lake Naomi Club, Inc. v. Rosado, ___ A.3d ___, 2022 WL __________ (Pa.Cmwlth. Nov. 2, 2022), the Commonwealth Court ruled that private communities cannot enforce restrictive covenants that prohibit lifetime registered sex offenders from residing within the community because they may not impose more restrictive standards on where released sex offenders may live than county and municipal governments.
