Sample Right-to-Know Policy Helps Townships Address Requests
With the changing landscape of Right-to-Know requests, including more requests being generated through online platforms and from unknown sources (including AI -artificial intelligence), townships are encouraged to review their open records policy (or consider adopting one!). PSATS has developed a sample RTK policy to help address some of the most common questions and concerns regarding records requests, including how to respond to anonymous requests, how records can be made available, what fees can be charged, and more.
For example, many townships are reporting that requests are received on a variety of forms or no form at all. A best practice would suggest that a township enact a policy to only accept requests that are submitted on the official Office of Open Records form, or the OOR form and a township form (note: townships must always accept requests submitted on the Office of Open Records form.) If the township has such a policy, it may deny requests that are not submitted on an approved required form. Similarly, if a township has a policy to not accept anonymous requests, it may deny anonymous requests.
Townships that choose to adopt RTKL policies need to prominently post these policies at the township office and on the township’s website, if you have one. If your township has a required form, that should be posted as well.
